Terms of Service
These Terms of Service ("Terms") govern your use of the services provided by ARM Digital Publishing LLC, operating as OWN-IT Business Service Portals ("OWN-IT," "we," "us"), a company based in Henderson, Nevada. By engaging our services, you agree to these Terms.
1. What we provide
OWN-IT designs, builds, and delivers custom client portal software ("the Portal") based on your requirements, gathered through a discovery process. Each engagement includes a client-facing dashboard and an administrative control panel, branded and configured for your business.
2. Fees and payment
Portal builds are offered at tiered one-time fees, disclosed before work begins. You may pay:
- Upfront — the full build fee, with split payments available by arrangement.
- Rent-to-own — a non-refundable start charge followed by fixed monthly payments until the total build fee is satisfied. The start charge counts toward your total.
Optional hosting and support are billed separately on a month-to-month basis and may be cancelled at any time. All fees are quoted in U.S. dollars.
3. Ownership
Once the build fee is paid in full — whether upfront or through completed rent-to-own payments — you own your Portal's configuration and content. At your request, we will migrate the Portal to infrastructure accounts you control. We retain ownership of our underlying methods, templates, and reusable components, which we may use to serve other clients.
4. Rent-to-own terms
Under rent-to-own, your Portal goes live and is fully usable from the start of the payment period. The start charge is non-refundable. If scheduled payments are not made, we may suspend access to the Portal until payment is resolved. Full ownership transfers only once the total build fee has been paid.
5. Hosting and support
If you choose our optional hosting, we maintain your Portal on infrastructure we manage. Support covers reasonable changes, fixes, and updates as described in your plan. Support does not include unlimited new feature development; substantial additions are quoted separately. We are not liable for downtime caused by third-party infrastructure providers.
6. Your responsibilities
You are responsible for the accuracy of content you provide, for how you use the Portal with your own clients, and for complying with laws applicable to your business and your data. You must not use the Portal for unlawful purposes or to store content you have no right to store.
7. Data
You retain ownership of the data you and your clients enter into the Portal. Our handling of personal data is described in our Privacy Policy. When you migrate off our hosting, we provide a reasonable means to export your data.
8. Warranties and liability
We deliver our services with reasonable skill and care. Except as required by law, the services are provided "as is" without further warranties. To the maximum extent permitted by law, our total liability arising from an engagement is limited to the fees you paid for that engagement.
9. Termination
You may cancel optional hosting or support at any time. We may suspend or end services for non-payment or breach of these Terms. Ownership rights already earned through full payment survive termination.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated to active clients. Continued use of our services after changes take effect constitutes acceptance.
11. Governing law
These Terms are governed by the laws of the State of Nevada, United States, without regard to conflict-of-law principles.
